Article II – Elections

Division 1 – Election of School Board Members

[Adopted 3-6-1995 (Ch. 15, Art. II, of the 1993 Code)]

§ 3.2-1 Title.

This article shall hereafter be known, cited and referred to as the “Election of School Board Members Ordinance of Appomattox County, Virginia.”

§ 3.2-2 Purpose.

This article is adopted for the following purposes:

A. To provide for the procedure for the lawful election of School Board members of Appomattox County, Virginia.

B. To provide for the composition and term limits of the School Board members of Appomattox County, Virginia.

C. To provide for the manner in which vacant seats on the School Board of Appomattox County, Virginia, are to be filled following the initial School Board elections.

§ 3.2-3 Jurisdiction.

This article shall apply to the election of School Board members in Appomattox County, Virginia.

§ 3.2-4 Legislative authority.

The Board of Supervisors has authority to adopt this article pursuant to a referendum held on November 3, 1992, pursuant to § 22.1-57.2 of the Code of Virginia, as amended, and after publication of the intent to pass an ordinance titled “Election of School Board Members Ordinance of Appomattox County, Virginia” once a week for two successive weeks in the Times-Virginian pursuant to § 15.1-504 of the Code of Virginia, as amended, and a public hearing held on the sixth day of March 1995 and pursuant to § 22.1-57.3 of the Code of Virginia, as amended, titled “Election of school board members.”

§ 3.2-5 Date of election.

A. The election of the School Board members and governing body members from each specific district shall be held simultaneously at regular general elections in November.

B. The initial election shall take place at the regular general election in November 1995.

C. There shall be one School Board member elected from each electoral district.

D. The election for School Board members from the Appomattox River Election District, the Wreck Island Election District and the Falling River Election District shall be held at the initial election in November 1995.

E. The election for School Board members from the Piney Mountain Election District and the Courthouse Election District shall be at the regular general election in November 1997.

§ 3.2-6 Term of office.

A. The term of any School Board member who was appointed by the governing body and is not elected at the initial School Board election, and whose appointed term expires before the election of the corresponding members of the governing body and after the initial election, shall continue or be extended to expire on December 31 of the year of the election of the School Board member replacing that appointed member.

B. The term for an elected School Board member shall be four years and shall begin on January 1 of the year following the election of the School Board member.

C. An appointed School Board member whose term expires before the regular general election of November 1995 shall be appointed by the Board of Supervisors in the same manner as in place before the effective date of this article.

§ 3.2-7 Vacancies.

A vacancy in the office of a School Board member shall be filled as provided in the Code of Virginia.

§ 3.2-8 Effective date.

This article shall be effective as of the sixth day of March 1995.

Division 2 – Election Districts

§ 3.2-9 Authority.

Pursuant to the authority and procedures contained in the Code of Virginia (as amended), the election districts and precincts of Appomattox County, Virginia, are hereby created and established as set forth below.

§ 3.2-10 Election districts established.

The election districts shall be as follows:

Appomattox River District
Courthouse District
Falling River District
Piney Mountain District
Wreck Island District

§ 3.2-11 Positions to be elected; terms of office.

There shall be one Supervisor and one School Board member elected from each election district. All districts shall have four-year terms and the terms are staggered.

§ 3.2-12 Boundaries and polling places.

The boundaries of each district and precinct, and the polling places for each, are as follows:

A. Appomattox River Election District.

(1) Election district boundary description:

Begin at the Town of Appomattox Limits at the intersection of Old Courthouse Road (Route 24). Proceed northeast along Old Courthouse Road to intersection of Old Grist Mill Road (Route 616)/Covington Road (State Forest road, unpaved). Turn left onto Covington Road and proceed to a point that intersects with the State Forest. Turn left at State Forest boundary and proceed north to intersection with North Wolf Creek. Turn left and follow North Wolf Creek southeast to intersection with VA-729 (unnamed State Forest Road). Turn left onto VA-729 Unnamed State Forest Road and travel east to intersection with Hollywood Road (Route 618). Turn Right and travel southeast along Hollywood Road to the intersection of Forbes Road (Route 614). Turn left onto Forbes Road and follow Forbes Road east to the Appomattox/Buckingham County line. Turn right and follow County line to its intersection with the Appomattox/Buckingham/Prince Edward County line. Turn right and follow Appomattox/Prince Edward County line southwest towards Pamplin. At Pamplin, County line intersects with Appomattox/Charlotte County line along Wheelers Spring Road (Route 638). Follow Wheelers Spring Road southwest to its intersection with Big Cub Creek. Turn right and follow Big Cub Creek northwest to its intersection with Rock Spring Road(Route 636). Turn left onto Rock Spring Road and follow it south to Chestnut Grove Road (Route 637). Turn right onto Chestnut Grove Road and proceed west to where Chestnut Grove Road intersects with Cub Creek Road (Route 644). Turn right onto Cub Creek Road north to intersection with Willow Oak Road (Route 720). Turn right and follow Willow Oak Road east to Trent Hatchery Road (Route 700). Turn Right onto Trent Hatchery Road and follow Trent Hatchery Road to intersection with Cedar Bend Road (Route 675). Turn left onto Cedar Bend Road to it intersects with Old Evergreen Road (Route 630). Turn left onto Old Evergreen Road north to a point where Old Evergreen Road intersects with the railroad tracks. Follow railroad tracks northwest to near eastern limits of Town of Appomattox. Jump to private road running due north to Kristi Lane (private). Follow Kristi Lane to Town of Appomattox Limits. Cross Richmond Highway (Route 460) and continue following Town Limits northwest to point of origin at Old Courthouse Road.

(2) Precinct boundaries and polling places:

(a) Vera Precinct.

[1] Precinct boundary description:

Begin at the Town of Appomattox Limits at the intersection of Old Courthouse Road. Proceed northeast along Old Courthouse Road to intersection of Old Grist Mill Road/Covington Road (State Forest road, unpaved). Turn left onto Covington Road and proceed to a point that intersects with the State Forest. Turn left at State Forest boundary and proceed north to intersection with North Wolf Creek. Turn left and follow North Wolf Creek southeast to intersection with VA-729 (unnamed State Forest road). Turn left onto VA-729 Unnamed State Forest road and travel east to intersection with Hollywood Road. Turn Right and travel southeast along Hollywood Road to the intersection of Forbes Road. Turn left onto Forbes Road and follow Forbes Road east to the Appomattox/Buckingham County line. Follow County line southeast to Appomattox River. Proceed south along the Appomattox River to Hollywood Road. Follow Suanee Creek to Hixburg Road. Turn right onto Hixburg Road to Poorhouse Creek Road. Proceed right along Poorhouse Creek Road to Morning Star Road, then turn left onto Morning Star Road and go to Richmond Highway. Turn left on Richmond Highway eastbound, then a quick right onto Wades Lane. Follow Wades Lane past its terminus, jumping to railroad tracks. Turn right and follow railroad tracks northwest to near eastern limits of Town of Appomattox. Jump to private road running due north to Kristi Lane. Follow Kristi lane to Town of Appomattox Limits. Follow Town Limits northwest to point of origin at Old Courthouse Road.

(b) Pamplin Precinct.

[1] Precinct boundary description:

Begin at intersection of Richmond Highway and Morning Star Road. Turn onto Morning Star Road and follow to Poorhouse Creek Road. Turn right onto Poorhouse Creek Road and proceed to Hixburg Road. Turn left onto Hixburg Road and follow to Suanee Creek. Follow Suanee Creek north to Hollywood Road. From that point, Suanee Creek and Hollywood Road intersect with the Appomattox River; follow the Appomattox River north to the Appomattox/Buckingham County line. Turn right and follow County line east to its intersection of Appomattox/Buckingham/Prince Edward County lines. Turn right and follow the Appomattox/Prince Edward County line south crossing Richmond Highway to a point where the County line intersects Wheelers Spring Road. Turn right onto Wheelers Spring Road, which is also the Appomattox/Charlotte County line. Follow Wheelers Spring Road southwest to its intersection with Big Cub Creek. Turn right and follow Big Cub Creek northwest to its intersection with Rock Spring Road. Turn left onto Rock Spring Road and follow it south to Chestnut Grove Road. Turn right onto Chestnut Grove Road and proceed west to where Chestnut Grove Road intersects with Cub Creek Road. Turn right onto Cub Creek Road north to intersection with Willow Oak Road. Turn right and follow Willow Oak Road east to Trent Hatchery Road. Turn Right onto Trent Hatchery Road and follow Trent Hatchery Road to intersection with Cedar Bend Road. Turn left onto Cedar Bend Road to it intersects with Old Evergreen Road. Turn left onto Old Evergreen Road and proceed to railroad tracks. Turn left and follow railroad tracks westbound to a point southwest of Wades Lane. Jump to Wades Lane. Follow Wades Lane to Richmond Highway. Turn left on Richmond Highway westbound heading back to the point of origin.

B. Courthouse Election District.

(1) Election district and precinct boundary description:

Begin at intersection of Richmond Highway (Route 460) and western Town of Appomattox Limits. Travel northeast long the town limits, crossing Richmond Highway at the eastern Town Limits. Turn left at Kristi Lane (private) and follow Kristi Lane past end of pavement to end of private road. Jump due south to railroad tracks. Turn left and follow railroad tracks southeast to a point where the railroad tracks intersect Old Evergreen Road (Route 630). Turn right onto Old Evergreen Road and follow it south to the intersection of Cedar Bend Road (Route 675). Turn right and follow Cedar Bend Road southwest to its intersection with Trent Hatchery Road (Route 700). Turn right onto Trent Hatchery Road. Follow Trent Hatchery Road west to Willow Oak Road (Route 720). Turn left onto Willow Oak Road and follow west to intersection with Cub Creek Road (Route 644). Turn right onto Cub Creek Road. Follow Cub Creek Road to the intersection of Red House Road (Route 727) and turn right onto Red House Road. Follow Red House Road north to its intersection with Promise Land Road (Route 604). Turn left onto Promise Land Road. Follow Promise Land Road west to its intersection with Purdum Mill Road (Route 719). Turn right onto Purdum Mill and go north to its intersection with Pumping Station Road (Route 691). Turn right onto Pumping Station Road and follow it east to the Appomattox County/Town of Appomattox limits where the street turns to Ferguson Street (Route 1008). Turn left and follow the Town of Appomattox limits along the railroad tracks to Richmond Highway at the point of origin.

C. Falling River Election District.

(1) Election district boundary description:

Begin at the intersection of Richmond Highway (Route 460)/Town of Appomattox limits at the western end of the town. Travel south following the Town of Appomattox limits to Pumping Station Road (Route 691). Turn right and follow Pumping Station Road to intersection with Purdum Mill Road (Route 719). Turn left onto Purdum Mill Road and follow south to intersection with Promise Land Road (Route 604). Turn left onto Promise Land Road and follow east to intersection with Red House Road (Route 727). Turn right onto Red House Road and follow south to intersection of Cub Creek Road (Route 644). Turn left onto Cub Creek Road and go to Chestnut Grove Road (Route 637). Turn left onto Chestnut Grove Road heading southeast to the intersection of Rock Spring Road (Route 636). Turn left onto Rock Spring Road and follow northeast to intersection with Big Cub Creek. Turn right and follow Big Cub Creek south to Appomattox/Charlotte County line at Wheelers Spring Road (Route 638). Turn right onto Wheelers Spring Road and follow Appomattox/Charlotte County line west to Appomattox/Campbell County line. Continue following Appomattox/Campbell County line north to intersection with railroad tracks in Concord. Follow railroad tracks eastbound to eastern intersection of Spout Spring Road (Route 689) and Richmond Highway. Jump onto Richmond Highway and follow eastbound to point of origin.

(2) Precinct boundaries and polling places:

(a) Chap Precinct.

[1] Precinct boundary description:

Begin at the intersection of Red House Road and Promise Land Road. Proceed south on Red House Road to Cub Creek Road. Turn left onto Cub Creek Road and go to Chestnut Grove Road. Turn left onto Chestnut Grove Road heading east to the intersection of Rock Spring Road. Turn left onto Rock Spring Road and follow northeast to intersection with Big Cub Creek. Turn right and follow Big Cub Creek south to Appomattox/Charlotte County line. Turn right onto Wheelers Spring Road which travels along County line. Head west on Wheelers Spring Road to its intersection with Red House Road, then continuing west along the Appomattox/Charlotte County line, then north along the Appomattox/Campbell County line to Dark Leaf Road. Turn right onto Dark Leaf Road and continue to intersection with Promise Land Road. Turn right onto Promise Land Road and follow back to the point of origin.

(b) Spout Spring Precinct.

[1] Precinct boundary description:

Begin at the intersection of Promise Land Road and Purdum Mill Road. Follow Purdum Mill Road to its intersection with Pumping Station Road. Turn right onto Pumping Station Road to the Appomattox County/Town of Appomattox limits. Road name changes to Ferguson Street. Turn left and follow Town of Appomattox limits to its intersection with Richmond Highway. Turn left onto Richmond Highway and follow west to eastern intersection of Spout Spring Road. Jump to adjoining railroad tracks and follow westbound to the Appomattox/Campbell County line. Turn left and follow Appomattox/Campbell County line south to its intersection with Dark Leaf Road. Turn left on to Dark Leaf Road and continue to intersection with Promise Land Road. Turn right onto Promise Land Road and follow to the point of origin.

D. Piney Mountain Election District.

(1) Election district boundary description:

Beginning at the intersection of Appomattox County/Town of Appomattox limits and Oakville Road (Route 26). Proceed north along Oakville Road to the intersection of Stonewall Road (Route 608). Turn left onto Stonewall Road, travel west to the intersection of Falling Creek Road (Route 667). Turn right onto Falling Creek Road and travel north to Trinity Road (Route 611). Turn left onto Trinity Road, continue west to the intersection of Stone Ridge Road (Route 721). Turn right onto Stone Ridge Road and continue north to the intersection with the James River/Appomattox/Amherst County line. Turn right and continue along the James River/County line northeast to its intersection with the Appomattox/Nelson/Amherst County line. Turn right and follow southeasterly along the Appomattox/Amherst County line, which becomes the Appomattox/Buckingham County line to its intersection with Forbes Road (Route 614). Turn right onto Forbes Road and continue west to the intersection with Hollywood Road (Route 618). Turn right onto Hollywood Road and travel north to its intersection with VA-729/unnamed State Forest Road. Turn left onto VA-729/unnamed State Forest Road and continue southwest to intersection with North Wolf Creek. Turn right and follow North Wolf Creek north to State Forest Boundary, then turn left to and follow State Forest Boundary to intersection of State Forest Boundary with Covington Road (State Forest road, unpaved). Turn right onto Covington Road and follow northwest to intersection of Old Gristmill Road (Route 616)/Old Courthouse Road (Route 24). Turn left onto Old Courthouse Road. Beginning at the intersection of Appomattox County/Town of Appomattox limits and Oakville Road. Proceed north along Oakville Road to the intersection of Stonewall Road. Turn left onto Stonewall Road, travel west to the intersection of Falling Creek Road. Turn right onto Falling Creek Road and travel north to Trinity Road. Turn left onto Trinity Road, continue west to the intersection of Stone Ridge Road. Turn right onto Stone Ridge Road and continue north to the intersection with the James River/Appomattox/Amherst County line. Turn right and continue along the James River/County line northeast to its intersection with the Appomattox/Nelson/Amherst County line at Bent Creek. Turn right onto Old Courthouse Road and follow to intersection of Old Gristmill Road/Covington Road (State Forest Road, unpaved). Turn left onto Old Gristmill/Covington Road. Follow Covington Road east to intersection with State Forest Boundary. Turn left and follow State Forest Boundary to intersection with North Wolf Creek. (1) Election district boundary.

Begin at the Richmond Highway (Route 460)/Town of Appomattox limits. Proceed west along Richmond Highway to the eastern intersection of Spout Spring Road (Route 689). Jump to railroad tracks. Turn right and follow railroad tracks to Appomattox/Campbell County line. Turn right and follow County line northwest to its intersection with the James River at a point connecting Appomattox/Amherst/Campbell counties. Turn right and follow the James River northeast to a point intersecting with Stone Ridge Road (Route 721). Turn right at Stone Ridge Road and follow it to the intersection of Trinity Road (Route 611). Turn left onto Trinity Road and follow east to intersection with Falling Creek Road (Route 667). Turn right and follow Falling Creek Road to its intersection with Stonewall Road (Route 608). Turn left onto Stonewall Road and follow east to its intersection with Oakville Road (Route 26). Turn right onto Oakville Road and proceed south to Town of Appomattox limits. Follow Town of Appomattox limits west to the point of origin at Richmond Highway.

(2) Precinct boundaries and polling places.

(a) Stonewall Precinct.

[1] Precinct boundary description:

Begin at the intersection of the railroad tracks and the Appomattox/Campbell County line. Follow County line northwest to its intersection with the James River at a point connecting Appomattox/Amherst/Campbell counties. Turn right and follow the James River northeast to a point intersecting with Stone Ridge Road. Turn right at Stone Ridge Road and follow it to the intersection of Trinity Road. Turn left onto Trinity Road and follow east to intersection with Falling Creek Road. Turn right and follow Falling Creek Road to its intersection with Stonewall Road. Turn right onto Stonewall Road and continue to a point where Stonewall Road and Hummingbird Lane converge. Continue along Hummingbird Lane south to Richmond Highway. Jump the railroad tracks. Turn right and follow the railroad tracks west to the point of origin at the Appomattox/Campbell County line.

[1] Precinct boundary description:

Beginning at Richmond Highway/Town of Appomattox limits. Proceed west along Richmond Highway to eastern intersection of Spout Spring Road. Jump to railroad tracks and follow railroad tracks westbound.

Proceed west near the intersection of Richmond Hwy and Hummingbird

Lane. Jump onto Hummingbird Lane and proceed northeast to the

convergence of Hummingbird Lane and Stonewall Road. Turn right onto

Stonewall Road and continue east to the intersection with Oakville Road. Turn

right onto Oakville Road and proceed south to the Town of Appomattox limits.

Turn right at the Town of Appomattox limits and follow it around to the point of

origin.

[2] Polling place:

F. Central Absentee Precinct (CAP). For the purpose of counting and recording ballots in all elections in Appomattox County, a Central Absentee Voter Election Precinct is hereby established at the Appomattox County School Administration Building, 316 Court Street, Appomattox, VA. (§ 24.2-712, Code of Virginia)

§ 3.2-13 Repealer.

The existing ordinance concerning Election Districts adopted by the Board of Supervisors on the 25th day of April, 2011, is hereby repealed.

§ 3.2-14 When effective.

This article shall take effect immediately upon adoption as provided in § 24.2-311 of the Code of Virginia and shall apply to all elections after May 15, 2022.

§ 3.2-15 Submission to proper authorities.

The County Attorney shall submit this article and accompanying materials to support this article to the proper authorities for preclearance and notification purposes.
