Chapter I – Traffic and Parking Regulations

§ 7.1-1 Adoption of state law by reference.

Pursuant to the authority of § 46.2-1313, Code of Virginia, as amended, all of the provisions and requirements of the laws of the state contained in Title 46.2 and Article 2 of Chapter 7 of Title 18.2 of the Code of Virginia, as in force on July 1, 1977, and as amended in the future, except those provisions and requirements the violation of which constitutes a felony and except those provisions and requirements which by their very nature can have no application to or within the County, are hereby adopted and incorporated in this chapter by reference and made applicable within the County. References to “highways of the state” contained in such provisions and requirements hereby adopted shall be deemed to refer to the streets, highways and other public ways within the County. Such provisions and requirements are hereby adopted, mutatis mutandis, and made a part of this chapter as fully as though set forth at length herein, and it shall be unlawful for any person within the County to violate or to fail, neglect or refuse to comply with any provision of Title 46.2 or Article 2 of Chapter 7 of Title 18.2 of the Code of Virginia which is adopted by this section, provided that in no event shall the penalty imposed for the violation of any provision or requirement hereby adopted exceed the penalty imposed for a similar offense under Title 46.2 or Article 2 of Chapter 7 of Title 18.2 of the Code of Virginia.

§ 7.1-2 Applicability to residential subdivisions.

The provisions of this chapter shall apply to all roadways open to the public within residential subdivisions in the County, whether or not such roadways are in public ownership or have been accepted into the state highway system.

§ 7.1-3 Applicability to County-owned property and to parking lots.

The provisions of this chapter shall apply to all County-owned property and to parking lots open to the public designed to accommodate 50 or more vehicles.

§ 7.1-4 Permit required for parades and processions; exceptions.

No funeral procession or parade, excepting the forces of the United States Army or Navy, the military forces of the state and police and fire vehicles and personnel, shall occupy, march or proceed along any street, road or highway except in accordance with a permit issued by the Board of Supervisors and such other regulations as are set forth in this chapter which may apply.

§ 7.1-5 Parking in fire lanes and areas for County trash containers prohibited.

It shall be unlawful for any person to park a vehicle within any area of public or privately owned property which is designated by signs to be a fire lane or an area reserved for County trash containers or to block access to a County trash container. Any person violating the provisions of this section shall be fined $5. Any vehicle violating the provisions of this section will be towed away at the expense of the owner thereof.

§ 7.1-6 Compliance required.

It shall be unlawful for any person to refuse, fail or neglect to comply with any of the provisions of this chapter or any rule or regulation promulgated pursuant thereto.

§ 7.1-7 Violations and penalties.

Every person convicted of a violation of any of the provisions of this chapter or any rule or regulation promulgated pursuant thereto for which no other penalty is provided shall be guilty of a traffic infraction punishable by a fine of not more than $250.
